Private hospital launches legal challenge against NHS trust that employed rogue breast surgeon

A private hospital company where the rogue surgeon Ian Paterson worked has launched a legal challenge against an NHS trust to determine whether the trust’s duty of care covered the surgeon’s private practice.
A trial is due to start in the High Court on 30 October 2017 to determine whether the Heart of England NHS Foundation Trust had a legal duty of care that extended to Paterson’s non-NHS patients. The case is being brought by Spire Healthcare, where Paterson conducted much of his private practice.
