Dr Berelowitz is correct in citing our policy on needing informed
consent for photographs, or indeed descriptions, of patients. However,
this applies to photographs obtained through a doctor-patient
relationship.
When it comes to news photographs we obtain these from
photographic agencies, who are responsible for obtaining the subject's
consent. The story about this boy, including quotes from his mother and
photographs of him, appeared widely in the US media. In effect the
photograph was already in the public domain.
