Cosmetic surgeon wins appeal against suspension from UK medical register

A cosmetic surgeon has won an appeal against a decision to suspend him from the UK medical register after a High Court judge ruled that a finding that he offered a patient a discount for surgery was “procedurally flawed and untenable.”1

Mr Justice Warby also ruled that allegations of misconduct in 2009 against Ashish Dutta should never even have been brought before the medical practitioners tribunal. The charges related to conduct more than five years before the decision to investigate and the General Medical Council’s resolve to go ahead with them was “unlawful,” said Warby.

In April 2009 Dutta performed a breast augmentation operation on a woman referred to as Patient A. She had a follow-up scan in 2010 and Dutta referred her to another surgeon, Dr B. In 2014 she complained to Dutta that Dr B had indecently assaulted her. …
