Section 4 of the Cancer Act 1939 is still in force, and prohibits certain advertisements relating to cancer. The legislation was enacted in a different era, of course, and was probably conceived as a deterrent for quackery then. Local authorities in England and Wales have a power to institute proceedings. Whether or not that power has ever been used is difficult to discover, and whether or not that would be an effective way of stopping the practice of crowdfunding is debatable. But that surely has to be considered, and perhaps a test case should be brought.
