A consultant haematologist who was sacked for seeing private patients when she was on sick leave from her NHS job with full sick pay has won a ruling that the employment tribunal that decided her dismissal was fair must look at her case again.
The tribunal ruled in 2011 that Ealing Hospital NHS Trust had acted reasonably in dismissing Finella Brito-Babapulle for gross misconduct.
