New York state’s attorney general, Eric Schneiderman, has issued subpoenas to three energy drink manufacturers, PepsiCo, Monster Beverage Corporation, and Living Essentials LLC, asking for information on the companies’ marketing and advertising practices.
The Wall Street Journal Online, which first reported the story, said that the investigation focused on whether the manufacturers were misleading customers with inaccurate labeling and advertising.1
A spokeswoman for the attorney general’s office told the BMJ that the office could not comment on ongoing investigations, nor could it reveal the content of the subpoenas.
Representatives for PepsiCo and Living Essentials declined to comment. Monster Beverage, the market leader by sales volume, had not responded to the BMJ’s inquiry at the time of going to press.
