Violence against doctors in China

In China, Yinao means the person who extort hospital in the name of helping patients. In the medical disputes which are more and more frequently happening in Chinese hospitals, Yinao are often found. Yinao wander around hospitals, inquiring medical disputes information. When they found one, they would contact with the patients immediately claiming they can help the patients to obtain compensation from the hospitals and get some money in return. If the patients agree, they would represent patients to blockade and attack hospitals even abuse and assault medical staff. The Yinao behaviors severely disturb hospitals’ working order, meantime fearing the Yinao influence on hospitals’ reputation, hospitals usually have to choose settle disputes by giving money. After patients receive money from the hospitals, Yinao would get their shares.

Yinao appears mostly because of the unbalanced game capacity between hospitals and patients in medical disputes. Patients were usually in a very weak position in medial disputes, difficult to acquire proof even they felt something wrong. Hospitals were often initiative parts. Hospitals and patients can not have equal dialogue. And the local arbitral body like the Medical Arbitration Commission, the Medical Accident Appraisal Committee, the Medical Association etc., although declaring neutral, but due to the close links with the hospitals, impartially verdicts were hard to be announced.

It is obvious that when patients can not get relief approach in legitimate way, they tend to choose illegitimate one. That’s why Yinao appears.

Patients get money by using Yinao, hospitals would transfer the loss by increasing medical cost of other patients, and the conflicts between doctors and patients were deepening day by day.

So settling Yinao, unfair medical disputes handling system should be changed firstly, and hospitals and patients should settle the disputes in accordance with law. Perfect medical insurance system should be established in order to decrease patients medical cost, which would lead to a better medical environment in China. Meantime, government should severely punish Yinao, impose criminal liability if required to effectively control Yinao behaviors.
