NHS trusts involved in disputes with families over their child’s treatment should not spend too long trying to secure parents’ agreement before taking the case to court, a UK High Court judge has warned.
Although trusts sometimes resorted to litigation too soon, in other cases crucial time could be lost trying to secure acquiescence, said Mr Justice Hayden, sitting in the Court of Protection in London.
