The government's failure to implement the EU working time directive has left it (and other public sector employers) wide open to legal challenge, according to the employment journal IDS Brief (1997; 595:17). Valid claims are currently indefensible because derogations-such as averaging the 48 hour week over six or twelve months-have yet to be enabled by changes to national law.
